Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Recensa platform ("Recensa," "we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If you are using Recensa on behalf of an organization, you represent that you have authority to bind that organization.
The service
Recensa is a software platform that helps consumer brands prepare packaging Extended Producer Responsibility (EPR) filings, estimate fees, and monitor reporting thresholds across states. Recensa provides tools and estimates to support your compliance work.
Estimates, not legal advice
Recensa provides estimates and informational tools. It is not a law firm and does not provide legal, tax, or professional compliance advice. Fee figures, obligation assessments, threshold projections, and other outputs are estimates based on the data you provide and on publicly available information, which may be incomplete or change over time. You are responsible for verifying your obligations and filings with the relevant state authorities or qualified professionals. Recensa does not guarantee the accuracy, completeness, or regulatory acceptance of any output.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. You must notify us promptly of any unauthorized use of your account.
Subscriptions and billing
Paid plans are billed in advance on an annual basis through our payment processor, Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. You can manage or cancel your subscription at any time from your billing settings. When you cancel, your subscription will not renew and you will not be billed for the next period; your access continues until the end of the current paid period. Fees already paid are generally non-refundable, though we are willing to review refund requests on a case-by-case basis. Contact us if you believe your situation warrants one.
Acceptable use
You agree not to misuse the service, including by attempting to access it without authorization, interfering with its operation, reverse engineering it, or using it to violate any law. You are responsible for the data you submit and for ensuring you have the right to use it.
Affiliate program
If you participate in the Recensa partner program, additional terms apply. Commissions are paid on qualifying paid subscriptions referred through your unique link, at the rate shown in your partner dashboard, and are subject to verification. We may modify or end the program, or decline or reverse commissions for referrals that are fraudulent, self-referred, or otherwise invalid. Limitation of liability
To the fullest extent permitted by law, Recensa and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the service. Our total liability for any claim arising out of these Terms or the service will not exceed the amount you paid to Recensa in the twelve months preceding the claim. The service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
Indemnification
You agree to indemnify and hold harmless Recensa from any claims, losses, or expenses arising from your use of the service, your data, or your violation of these Terms.
Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Wyoming.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date, and continued use of the service after changes take effect constitutes acceptance.
